1. Постачальник та сфера діяльності
1.1. Будь ласка, уважно прочитайте ці Умови (“Умови”). Вони регулюють договірні відносини між вами (“Клієнт”) та Entrio sp. z o.o., зареєстрованою за адресою: вул. Загурна 28, 37-420 Копкі, Польща, номер реєстрації: KRS 0001235479, VAT ID: PL6020153342, REGON: 544507404 (далі – “Tollentrio”, “ми” або “нас”).

1.3. “Споживач” – це будь-яка фізична особа, яка укладає правочин з метою, яку, переважно, не можна віднести ані до її комерційної, ані до її професійної діяльності, що здійснюється самостійно. “Діловий клієнт” – це будь-яка фізична чи юридична особа, яка діє в рамках своєї комерційної або професійної діяльності, що здійснюється самостійно.
1.4. Розміщуючи замовлення через Tollentrio, ви підтверджуєте, що прочитали, зрозуміли та прийняли ці Умови. Конфліктуючі умови Замовника не застосовуються.
2. Предмет договору та опис послуг
2.1. Tollentrio керує вебсайтом tollto.com, через який клієнти можуть придбати цифрові дорожні віньєтки (“е-віньєтки”) для європейських країн, які стягують плату за користування автомагістралями та національними дорогами.
2.2. Tollentrio є незалежним постачальником послуг, а не державним органом. Ми виступаємо як посередник, який реєструє електронні віньєтки від імені Клієнта у відповідному національному органі, що стягує плату за проїзд відповідної країни.
2.3. Опис послуги: Клієнт доручає Tollentrio зареєструвати конкретний транспортний засіб (ідентифікований за його номерним знаком) в електронній базі даних компетентного органу збору плати за проїзд країни призначення на термін дії, обраний Клієнтом, та для певної категорії транспортного засобу. Tollentrio здійснює цю реєстрацію від імені Клієнта та стягує плату за послуги на додаток до державного збору за проїзд. Клієнт отримує підтвердження реєстрації електронною поштою (та за бажанням SMS).
2.4. Країни, що обслуговуються на даний момент: Австрія, Чехія, Словаччина, Угорщина, Румунія, Болгарія, Словенія, Швейцарія та Молдова. Tollentrio може додавати або видаляти країни в будь-який час.
2.5. Електронні віньєтки видаються виключно компетентним органом країни призначення. Tollentrio не має жодного впливу на рішення органу щодо видачі або відмови у видачі електронної віньєтки. Характер та обсяг наданих послуг регулюються законодавством відповідної країни призначення.
2.6. Реєстраційний номер транспортного засобу (номерний знак), наданий Клієнтом, є обов'язковим для видачі електронної віньєтки. Клієнт несе одноосібну відповідальність за достовірність усіх наданих даних, включаючи номерний знак, країну реєстрації та категорію транспортного засобу.
2.7. Tollentrio є приватним постачальником послуг і не має жодного зв'язку, підтримки чи доручення від будь-якого державного органу. Клієнти можуть придбати електронні віньєтки безпосередньо на державних вебсайтах відповідних країн. Наша послуга полягає в допомозі в процесі реєстрації від імені Клієнта за додаткову плату за послуги.
2.8. Клієнтів інформують, що вони можуть придбати електронні віньєтки безпосередньо у державних постачальників, як правило, за нижчою ціною, без додаткової плати за послуги, яку стягує Tollentrio.
3. Укладення договору
3.1. Презентація послуг та продуктів на нашому вебсайті не є юридично зобов'язуючою пропозицією, а радше запрошенням до Клієнта зробити замовлення.
3.2. Натискаючи кнопку остаточного підтвердження замовлення, Клієнт розміщує обов'язкове замовлення на послуги, перелічені на сторінці замовлення.
3.3. Tollentrio підтверджує отримання замовлення, надсилаючи електронний лист із підтвердженням. Це підтвердження отримання ще не є прийняттям пропозиції.
3.4. Договір вважається укладеним з моменту підтвердження Tollentrio успішної реєстрації електронної віньєтки та надсилання підтверджуючого документа на електронну адресу Клієнта.
3.5. Мовою договору є англійська. Переклади цих Умов надаються виключно для зручності. У разі розбіжностей перевагу має англійська версія.
4. Ціни та оплата
- Державний збір (платний проїзд) – збір національного органу, що стягує плату за проїзд;
- Сервісний збір — наш збір за послуги реєстрації, обробки, підтримки клієнтів та доставки.

4.5. Оплата має бути здійснена негайно після оформлення замовлення. Електронна віньєтка буде зареєстрована лише після успішного отримання оплати.
4.6. Рахунки-фактури надсилаються Покупцеві електронною поштою в електронній формі. Покупець погоджується, що електронний рахунок-фактура замінює паперовий.
4.7. Залежно від місцезнаходження Покупця, податок на додану вартість може застосовуватися відповідно до чинних норм Європейського Союзу.
4.8. Плата за проїзд по державному шосе. Таблиці нижче містять державні дорожні збори, встановлені компетентними національними дорожніми органами. Ці збори разом із сервісним збором включені у вартість Tollentrio. Збори можуть бути змінені відповідними органами.

Note: The prices below are the state toll fees published by the national toll authorities. Tollentrio additionally charges a service fee for registration, processing, customer support and delivery. The full price breakdown is shown to the customer before order confirmation.
5. Delivery terms
5.1. Digital delivery only. Tollentrio provides a fully digital service. No physical goods are shipped. The e-vignette confirmation is delivered exclusively by email to the address provided by the Customer during the order process.
5.2. After successful payment, the e-vignette confirmation is normally delivered within 30 minutes during business hours.
5.3. Business hours are 07:00 – 24:00 CET, 7 days a week. Orders placed outside business hours (between 00:00 and 07:00 CET) are processed from 07:00 CET on the next morning in the order they were received.
5.4. It is the Customer’s responsibility to provide a valid, reachable email address. Tollentrio is not liable for non-delivery due to incorrect email addresses, spam filters or full mailboxes.
5.5. If the Customer optionally selects SMS notification, a confirmation will also be sent by SMS to the phone number provided for an additional fee.
5.6. If the Customer does not receive the e-vignette confirmation within a reasonable time, they should check their spam/junk folder and then contact help@tollto.com.
6. Customer obligations
6.1. The Customer is obliged to provide accurate and complete information, in particular:
- Vehicle registration number (number plate);
- Country of registration of the vehicle;
- Vehicle category/type;
- Desired validity period and start date of the vignette;
- Valid email address and contact details.
6.2. The Customer warrants that they are the driver or the registered keeper of the vehicle, or that they are duly authorised by the registered keeper to purchase the e-vignette.
6.3. Tollentrio is not responsible for consequences arising from incorrect information provided by the Customer. Once the e-vignette has been registered with the competent authority, errors in data entry (in particular the number plate) can generally no longer be corrected.
6.4. Tollentrio does not guarantee the successful registration or validity of the e-vignette if the Customer provides incorrect or incomplete information.
7. Right of withdrawal
7.1. Consumers have the right to withdraw from this contract within 14 days without giving any reason, provided the service has not yet been fully performed.
7.2. The withdrawal period is 14 days from the day the contract is concluded.
7.3. To exercise the right of withdrawal, the Customer must inform us by an unambiguous statement (e.g. by post or email) of their decision to withdraw from this contract. Contact details:

7.4. To meet the withdrawal deadline it is sufficient to send the notification of the exercise of the right of withdrawal before the withdrawal period expires.
Наслідки виведення
7.5. If the Customer withdraws from this contract, we will refund all payments received from the Customer without undue delay and no later than within 14 days from the day on which we receive the notification of withdrawal. We will use the same means of payment as used in the original transaction.
Дострокове припинення права на відмову
7.6. Important: The right of withdrawal expires early if Tollentrio has fully performed the service (i.e. the e-vignette has been successfully registered with the toll authority) and the Customer has previously expressly consented to Tollentrio starting performance before the withdrawal period expires, and has acknowledged that the right of withdrawal will be lost upon full performance of the contract.
7.7. By confirming the order, the Customer expressly consents to the immediate commencement of the registration service and acknowledges that the right of withdrawal expires as soon as the e-vignette has been successfully registered with the competent authority.
8. Refunds & returns
8.1. Due to the nature of the service (digital registration with a government authority), refunds are generally not possible once the e-vignette has been registered, as the registration cannot be reversed.
8.2. Refunds may be granted in the following cases:
- The e-vignette was not registered due to a technical error on the part of Tollentrio;
- A duplicate order was placed and the Customer was charged twice for the same service;
- The order was cancelled before registration was completed.
8.3. Refund requests must be submitted in writing to help@tollto.com within 14 days of the order date, including the order number and a description of the issue.
8.4. In the case of an approved refund, the state fee component will only be refunded if a reversal is possible with the competent authority. The service fee is non-refundable once registration has been initiated.
8.5. Refunds are processed within 14 business days via the original payment method.
8.6. Refund requests due to incorrect data entry by the Customer (e.g. wrong number plate) will not be accepted, as Tollentrio has no control over the registration once submitted to the competent authority.

8.8. Nothing in this section limits or excludes consumers’ statutory rights under applicable law, including rights under EU consumer protection regulations.
9. Liability
9.1. Tollentrio is liable for damages only in case of gross negligence or wilful misconduct on the part of Tollentrio or its agents.
9.2. Tollentrio is not liable for:
- Errors or delays caused by the competent toll authority;
- Consequences of incorrect information provided by the Customer;
- Temporary unavailability of the website or the toll authority’s systems;
- Indirect or consequential damages, including fines, penalties or travel delays.
9.3. Liability for damages to life, body or health and liability under mandatory statutory provisions remain unaffected.
9a. Chargebacks & payment disputes
9a.1. If a Customer initiates a chargeback or payment dispute through their bank or card provider for a service that was lawfully provided, Tollentrio reserves the right to contest the chargeback and provide the payment provider with evidence of the completed registration.
9a.2. We strongly recommend that Customers contact help@tollto.com directly before initiating a chargeback, so we can resolve the issue quickly and amicably.
9a.3. Fraudulent chargebacks (i.e. chargebacks for services correctly provided) may result in the Customer being held liable for any fees or costs incurred by Tollentrio as a result of the dispute.
9a.4. In the event of a payment dispute, Tollentrio reserves the right to provide the payment provider with evidence, including order details, IP address, transaction data and confirmation of the successful e-vignette registration.
10. Intellectual property
10.1. All content on the Tollentrio website, including texts, graphics, logos, images and software, is the property of Entrio sp. z o.o. or its licensors and is protected by copyright and industrial property rights.
10.2. Reproduction, distribution or other use of content from this website without prior written consent is prohibited.
11. Governing law & jurisdiction
11.1. These Terms and the contractual relationship between the Customer and Tollentrio are governed by the law of the Republic of Poland, excluding the UN Convention on Contracts for the International Sale of Goods (CISG).
11.2. For Business Customers, the exclusive place of jurisdiction for all disputes arising from or in connection with this contract is the competent court at the registered seat of Entrio sp. z o.o..
11.3. For Consumers, statutory jurisdiction rules apply. Consumers may also sue before the courts of their habitual residence.
12. Complaints & dispute resolution
12.1. Complaints procedure: if you are not satisfied with our services, please contact us at help@tollto.com with a description of the problem and your order number. We will confirm receipt of your complaint within 2 business days and endeavour to resolve all complaints within 14 business days.
12.2. The European Commission provides a platform for online dispute resolution (ODR), available at: https://ec.europa.eu/consumers/odr.
12.3. Our email address can be found in section 1 of these Terms.
12.4. Tollentrio is neither obliged nor willing to participate in dispute resolution proceedings before a consumer arbitration board, unless required by law.
13. Changes
13.1. Tollentrio reserves the right to amend these Terms at any time. The amended version will be published on the website. Existing contracts are governed by the Terms that applied at the time the contract was concluded.
13.2. If one or more provisions of these Terms are or become invalid, the validity of the remaining provisions remains unaffected.
14. Final provisions
14.1. Additions and amendments to the contract between the Customer and Tollentrio must be made in text form (email is sufficient).
14.2. Verbal side agreements are deemed non-binding.
